CALIFORNIA HANDS-FREE CELLPHONE LAW NOW IN EFFECT

ASCIP members are encouraged to inform their staff of Assembly Bill 1785 that has tightened restrictions on cellphone use while driving.  A person is now prohibited from driving a motor vehicle while holding and operating a handheld wireless phone or electronic wireless communications device unless the phone or device is specifically designed and configured to allow voice-operated and hands-free operation, and is used in that manner while driving.

As a safety precaution, employees should be reminded to avoid all driving distractions, including abstaining from cell phone use while driving on district business.  Members who have a cell phone usage policy in place should evaluate their current policy and adjust accordingly to conform with the new law.

AVOID DISTRACTED DRIVING

On January 1, 2017, Assembly Bill 1785 went into effect which states a motorist can only use his or her hand to activate or deactivate a feature or function on their wireless electronic device that requires a single swipe or tap.  With the new law, the devices must be mounted and then if a driver’s hand does make contact, it can only be a single touch or swipe.  The law does not apply to systems that are installed by manufacturers and embedded in the vehicle.

The prior law restricted a person from using a wireless electronic device to write, send or read a text-based communication while operating a motor vehicle, except through voice-operated and hands-free features.
