How do I report a workers' compensation claim?

What is Company Nurse?

Company Nurse is a “Day of Injury” service that will triage a work related injury and guide the employee to the correct level of care for treatment based upon information obtained during the triage process. All work related injuries are required to go through the Company Nurse when reporting an injury.

What are my notice posting requirements?

You must post the “Notice to Employees” poster in a common area at the work site, such as a break room. This poster provides employees with information on your workers' compensation coverage and where to get medical care for work injuries. Failure to post this notice is a misdemeanor that can result in a civil penalty of up to $7,000 per violation.

What am I required to give to new hires about workers' compensation?

You must provide newly hired employees with a workers’ compensation pamphlet titled “Facts about Workers’ Compensation” explaining their rights and responsibilities, a Pre-Designation Form, and a Medical Provider Network (MPN) Pamphlet. Please contact ASCIP’s Workers’ Compensation Department to request “Facts about Workers’ Compensation” pamphlets. Other forms are available in the forms and resources section.

What is a Medical Provider Network?

A medical provider network (MPN) is a network of providers, including physicians, specialists and physical therapists, created to provide medical treatment for employee work related injuries in California. All ASCIP workers' compensation member districts participate in the MPN. MPN's are used exclusively unless an employee has a confirmed pre-designated personal physician prior to an incident, injury or illness.

Who is covered under our workers' compensation program?

Workers’ compensation benefits are available to member districts’ employees, substitutes, volunteers (if Board approved), and students in an authorized Regional Occupational Program (ROP) provided the injury or illness arose out of and was in the course and scope of their employment with the district.

What should I do if an employee refuses medical treatment?

In the event an employee chooses to only report an injury or illness and does not currently wish to pursue a claim or medical treatment, you should complete the “Workers’ Compensation Report Only Form”, have the employee complete and sign the “Declination of Medical Examination/Treatment”, and keep both forms on file. The injured employee has a maximum period of one year from the date of injury to obtain medical treatment and benefits.

What can I do if I think an employee's workers' compensation claim is not valid?

You should report that opinion to your workers' compensation claims administrator. Tell them all the facts you know, any witnesses you may be aware of, and the people they should speak with. They will utilize the information provided in their investigation.
